COUNCIL OF MINISTERS

ROYAL GOVERNMENT OF CAMBODIA

SECHDEY SAMRECH (DECISION)
DECISION NO. 34 ON THE CREATION OF A NATIONAL COMMITTEE  FOR LAND PLANNING AND URBANIZATION OF AREAS SURROUNDING PHNOM PENH, TOWNS  AND PROVINCES IN THE KINGDOM OF CAMBODIA
Phnom Penh, October 18, 1993

•    Seen the Constitution of the Kingdom  of Cambodia, and
•    Responding to the exigent needs

IT IS HEREBY DECIDED

ARTICLE 1:
To create the “National Committee for Land Planning and Urbanization for Areas Surrounding Phnom Penh, Towns and Provinces in the Kingdom of Cambodia”
The composition of the National Committee shall be as follows:
1.      H.E. Vann Molivann          Senior Minister                       Chairman
2.      H.E. Kong Sam Ol            Minister of Agriculture             Member
3.      H.E. Mok Maret                Minister of Environment           Member
4.      H.E. Eng Roland               Minister of Tourism                  Member
ARTICLE 2:
The tasks of the National Committee shall be as follows:
a).      to protect the natural resources of the nation
b).     to create policies aimed at encouraging people to take part in the economic, cultural and social development in provinces and towns.
c)     to study and prepare the master plans for all purposes public places in the provinces and towns.
d)     to control the constructions of factories, hotels, restaurants, shops and houses, etc. so as to be in harmony with the local landscape conditions.
e)     to plan areas reserved for development in accordance with the master plans.
f)      to maintain protected land areas surrounding rivers, lakes, and ponds for water and traffic usage.
g)     to protect natural areas, forestry reserves and recreation parks
h)     to determine areas for residential, commercial, cultural, and administrative constructions, areas for slaughterhouses, facilities for utilities, transportations, and maintain clean environment particularly with reference to air, water and noise pollution.
i)      to protect from constructions and settlements land along public places, schools, sports fields, parks, monasteries and infirmaries, railways and water channels, etc.
j)      to cooperate with relevant ministries and institutions to prepare policies and draft  laws pertaining to planning of Phnom Penh or other cities and provinces, and to submit them to the Royal Government to be adopted by the national Assembly.
k)     to educate people to participate in the protection and the beautification of the environment and landscapes of towns and countryside.
ARTICLE 3:
The “National Committee” shall have the right to establish an executive secretariat at the Cabinet of the Prime Ministers to assist with its duties.
ARTICLE 4:
Each province and town shall have a sub-committee directly under the supervision of the Governor in order to implement the directives as well as to report its activities to the National Committee as specified in Article 2.
ARTICLE 5:
The National Committee shall have the right to cooperate with national institutions, international and public organizations and the regional foundations to obtain financial support in order to implement the above plans and objectives, and to determine its own budget.
ARTICLE 6:
The “National Committee” shall have the right to apply the seal of the Cabinet of the Council of Ministers.
ARTICLE 7:
Any provision contrary to this decision shall be annulled.
ARTICLE 8:
The Co-ministers in charge of the Cabinet of the Council of Ministers, Ministers and Secretaries of State in relevant ministries and institutions in provinces and towns, Excellencies and officials named in Article 1 shall implement this Sub-Decree from the date of its signatures.
